Delhi, 24 January (H.S.): The Supreme Court today took an important decision and dismissed the petition challenging the provision of TDS, the system of tax collection. The bench headed by Chief Justice Sanjeev Khanna said that the petitioner has been allowed to file a petition in the High Court.

The Supreme Court refused to hear the petition under Article 32 of the Constitution and said that in many cases the provision of TDS has been considered correct by the courts. This petition was filed by BJP leader and lawyer Ashwini Upadhyay. In the petition, the current TDS system of tax collection was described as arbitrary, illogical and a violation of fundamental rights. In the petition, a demand was made to abolish the TDS system.

TDS is such a provision of tax under which if a person pays salary, rent, or commission etc. to someone, then he pays it after deducting tax in the form of TDS. In such a situation, the person to whom the payment has been made is paid when he files his income tax return, after assessing tax on his income, the deduction made in the form of TDS is paid.
