Thiruvananthapuram, 11 June (H.S.):T. Veena, one of the accused in the Enforcement Directorate’s (ED) investigation into the alleged financial transactions between Cochin Minerals and Rutile Ltd. (CMRL) and Exalogic Solutions, has sought exemption from appearing before the agency’s Kochi unit on Friday, citing health-related reasons.

According to sources, the ED received Veena’s request via email on Wednesday morning. In her communication, she stated that health issues would prevent her from appearing in person as directed in the summons issued by the agency.

Veena has reportedly informed the ED that all documents sought by investigators, along with written responses to their queries, could be submitted through her legal counsel. However, the agency is yet to take a final decision on the request.

Officials are expected to communicate the ED’s stand on the exemption plea to Veena on Thursday. Even if the agency grants a short postponement, she may still be required to appear in person on a later date as part of the ongoing investigation.

The summons was issued under Section 50 of the Prevention of Money Laundering Act (PMLA), which empowers the ED to require the personal attendance of individuals during an inquiry and seek the production of relevant records and documents.

Legal experts note that summons issued under Section 50 carry significant legal weight and are treated on par with those issued by a civil court. As a result, individuals receiving such notices are generally obligated to cooperate with the investigation and furnish all information and records sought by the agency.

While the ED has, in certain cases, considered requests for exemption on medical grounds when supported by appropriate medical documentation, the law also provides the agency with the authority to insist on personal appearance if deemed necessary for the investigation.

The CMRL–Exalogic case is being probed by the ED under provisions of the PMLA, with investigators examining the nature of financial transactions linked to the entities involved.
