Aug (HS): The Gautam Buddh Nagar district court sentenced a man guilty of

digital rape (finger in the private parts) of a three and a half year old girl

in a private school to life imprisonment. The court imposed a fine of Rs. 24,000

on him. If the fine amount is not deposited, he will have to undergo additional

imprisonment of six months. The court also imposed a fine of 10 lakh rupees on

the school. Assistant Government Advocate of the district Chawanpal Singh said

that on 12th July 2018, a three and a half year old innocent girl was raped in

DPS school of Greater Noida. At the time of the incident, the girl was present

near the swimming pool.

Meanwhile, the

lifeguard of the swimming pool, Chandidas, took the girl near a wall. The

lifeguard did a disgusting thing with the girl. On getting information about

this incident, the family members registered a case against the accused

lifeguard Chandidas in Surajpur police station. The police took action and

arrested the accused Chandidas, a resident of West Bengal. The police filed a

chargesheet in the court in this case. On the basis of witnesses and evidence,

the court held Chandidas guilty and sentenced him to life imprisonment. The

school management was accused of pressurizing. After this incident, the school

management was accused that after getting information about the case, instead

of taking action, they tried to suppress the matter for two days. To hush up

this matter, pressure was also put on the girl's parents. The parents raised

their voice in protest. After this, the police registered a case and arrested

the accused Chandidas. During the incident, the accused lived in Greenwood

Society of Greater Noida.

While imposing a

fine of Rs 10 lakh on the school, the court, exercising powers under

sub-section (8) of section 33 of the POCSO Act, held the DPS Society liable for

the act of gross negligence and ordered them to pay Rs 10 lakh within one month

from the date of the order. This amount has to be deposited in the office of

the District Legal Services Authority. This amount should be used to compensate

the victim and her family.

Order to prosecute

two women: In the case of digital rape of a three-and-a-half-year-old girl in

DPS school located in Thana Surajpur area, the court has ordered to prosecute

the then investigating officer woman sub-inspector Sita Singh and Rashmi

Chaudhary by including them as co-accused in this crime for irregularities in

the investigation.

Assistant

Government Advocate Chavanpal Bhati said that the court of Additional District

Sessions and Special Judge Vijay Kumar of POCSO II has issued summons to the

investigating officer Sita Singh and Rashmi Chaudhary in this case and said

that a copy of it should be sent to the Director General of Police of Uttar

Pradesh for information and necessary action. The file of this decision should

be archived and a new file should be opened under the same case crime number for

the trial of the co-accused, in which the next date is on 8 September 2025.

Charges will be framed on this day. He told that the court said that the

closure report filed by the later investigating officers Sita Singh and Rashmi

Chaudhary in favor of the then Principal Renu Chaturvedi and teacher Hina

Lohani in this case is contrary to the evidence available on record. They tried

to save the then Principal and class teacher by conducting a faulty and biased

investigation, while they were made accused. The proceedings in this case will

start afresh and the witnesses will be heard again. After this order of the

court, there is a stir in the police department. People say that action will

soon be taken against the police officers who have been made co-accused.
