01 June (HS): Abbas Ansari, son of gangster-turned-politician Mukhtar Ansari,
was disqualified from the Uttar Pradesh assembly after being convicted to two
years for hate speech. His conviction
arises from a 2022 event in which he threatened the local authority, resulting
in multiple charges under the Indian Penal Code (IPC). Under the Representation of the People Act, a
legislator's membership can be canceled if they are sentenced to two years or
more in prison. Abbas was elected as an
MLA for the first time in 2022, winning the Mau Sadar assembly seat on an SBSP
ticket, which was part of the Samajwadi Party-led coalition at the time.
The
secretariat has also sent information to the Election Commission about the Mau
assembly seat being vacant. It may be noted that Mukhtar Ansari's son Abbas
Ansari became MLA for the first time after winning the election from Mau Sadar
assembly seat. In a hate speech case, the special court held him guilty on
Saturday and sentenced him to two years imprisonment. There is a legal
provision for losing the membership of the assembly in case of two years or
more punishment in any case. Ever since Abbas was sentenced, there were
speculations about him losing his MLA post. On Sunday, the assembly secretariat
has cancelled Abbas Ansari's membership of the assembly in this regard.
Information has been sent to the Election Commission. Now the Election
Commission will take a big decision.

Principal Secretary Pradeep Dubey told reporters on Sunday that Abbas Ansari's
assembly membership has been terminated. A proposal has been sent to the Chief
Election Officer of UP to hold a by-election. With this, the possibility of a
by-election on the Mau Sadar seat has increased. Abbas Ansari's father Mukhtar
Ansari was also an MLA from this seat. Abbas had threatened in an inflammatory
speech in an election rally during the assembly elections and said that he
would see things when his government came to power. Abbas Ansari was arrested
in this case. Now the court has sentenced him to two years of imprisonment.
