
New Delhi, 03 June (H.S.): A Delhi court on Wednesday issued a non-bailable warrant against absconding accused Kapil Sangwan, who is linked to a case under the Maharashtra Control of Organised Crime Act (MCOCA) and is alleged to have connections with Aam Aadmi Party leader Naresh Balyan. Special Judge Vishal Gogne of the Rouse Avenue Court also extended the judicial custody of the other accused in the case until June 9.
During the hearing, the court sought an update from Delhi Police regarding the whereabouts of Kapil Sangwan. The investigating officer informed the court that no trace of him had been found so far. The court noted that Delhi Police, in its chargesheet, had sought the commencement of trial in Sangwan’s absence under Section 356 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
The court observed that under Section 356(1) of the BNSS, two consecutive warrants must be issued before a trial can proceed in the absence of an accused, with a mandatory interval of 30 days between the two warrants. Accordingly, the court issued a warrant against Kapil Sangwan and directed him to appear before the court on June 9.
Delhi Police had filed its sixth supplementary chargesheet in the case on April 17. Earlier, on January 24, the court had taken cognisance of the fifth supplementary chargesheet filed against Manoj Yadav. The court had taken cognisance of the chargesheet against Manoj Yadav alias Kaira under Sections 3 and 4 of MCOCA.
According to the chargesheet, Manoj Yadav is a member of an organised crime syndicate allegedly operated by Kapil Sangwan alias Nandu, who remains absconding. The police investigation revealed that multiple FIRs relating to criminal activities had been registered against Manoj Yadav.
According to Delhi Police, the case involving alleged conversations between Naresh Balyan and the gangster dates back to 2023, and an FIR was registered the same year. Kapil Sangwan is a notorious gangster who is currently believed to be residing in the United Kingdom. Police records indicate that he has been living there for the past five years.
Both Kapil Sangwan and Naresh Balyan hail from the Najafgarh area of Delhi. Sangwan is also alleged to be the mastermind behind the murder of Nafe Singh in Haryana. He is further suspected of masterminding the killings of Ballu Pehlwan and BJP leader Surender Matiala.
