Delhi, 17 January (H.S.): The Supreme Court has asked the investigating agencies and trial courts to be very cautious about making allegations of abetment to suicide. The bench headed by Justice AS Oka has made it clear in its important decision that in such cases, this allegation should not be made only for the purpose of consoling or satisfying the family members who have lost their loved ones.

The court said that the investigating agencies should be so serious that they do not unnecessarily harass the accused in cases under Section 306 of the Indian Penal Code (now Section 108 in the Indian Justice Code). The trial court should also keep this in mind while framing charges in such cases.

The Supreme Court said that there are strict criteria to prove abetment to suicide, for which many types of evidence are required. The court said that it cannot be separated from the daily realities of life. Under this provision, there is a provision of ten years imprisonment and fine.
