
Kolkata, 05 June (H.S.) : The Calcutta High Court has taken serious note of allegations that arrested accused persons in West Bengal are being paraded on streets with ropes tied around their waists, and has sought a detailed report from the state government on the matter.
A division bench comprising Justice Jay Sengupta and Justice Smita Das De heard a set of public interest litigations on Friday concerning the issue. During the hearing, the court observed that while police have the authority to arrest and take necessary legal action, the dignity of an accused cannot be compromised under the pretext of arrest or investigation.
The petitions alleged that in several parts of the state, arrested individuals were being publicly displayed in such a manner after detention, which has resulted in damage to their social reputation and dignity. The petitioners termed the practice unlawful and a violation of human dignity.
In response, the state government informed the court that those arrested are primarily accused in serious offences such as extortion, and in some cases are taken to crime scenes for reconstruction purposes. However, the court questioned whether there is a genuine risk of escape in all such cases and whether such public display is necessary even when adequate security measures are in place.
The bench directed the police to ensure that both the safety and dignity of arrested individuals are protected during all stages of custody and investigation. It further directed the state government to submit a written report within three weeks explaining the rationale behind such practices.
The matter has been listed for further hearing after four weeks.
