Kolkata, 23 April (H.S.): The Calcutta High Court on Thursday made sharp observations against the Election Commission over its restriction on the use of motorcycles during the West Bengal Assembly elections, saying the poll body was misusing its powers and causing unnecessary harassment to ordinary citizens.

During the hearing, Justice Krishna Rao questioned why such a restriction had been imposed two days before polling. The court directed the Election Commission to file an affidavit on Friday explaining the necessity of the order.

Justice Rao observed that the rights of common citizens cannot be curtailed in such a manner. Making a strong remark, he said that if this logic was to be followed, then cars should also be banned, as weapons could also be transported in them to create disturbances.

The court further asked the Commission to provide data on how many instances had occurred in the last five years where motorcycle riders were involved in poll-related violence or unrest. The judge said bringing normal movement to a halt two days before polling could not be considered a justified step.

Justice Rao also remarked that the order appeared to be an attempt to cover up administrative failure.

The Election Commission’s directive was challenged before the High Court on Wednesday, when the court had permitted the filing of the petition. The matter came up for hearing on Thursday.

The Commission is now required to place its stand before the court through an affidavit on Friday, detailing the reasons behind the restriction and citing any past incidents related to motorcycles during elections.
