New Delhi, 13 March (H.S.): The Delhi High Court rebuked Delhi Police for endless investigations, questioning when hearings on charges would commence if probes drag on indefinitely in AAP leader Naresh Balyan's MCOCA case.
Justice Swarnkanta Sharma's bench, hearing Balyan's bail plea, demanded timelines for completing the MCOCA probe, noting the accused has languished in jail for two years. Next hearing set for March 30.
Senior advocate Rebecca John highlighted voice samples taken from Balyan but not others, prompting the court to query charge framing delays. Police counsel Amit Prasad cited ongoing investigation, but the bench retorted that trial determines guilt—charges must precede it.
Arrested in 2024, now it's 2026—if police keeps probing, when will charges be heard?Case BackgroundBalyan contests MCOCA applicability, denying continuous criminal involvement. Prior counsel N. Hariharan argued no solid evidence links him to 15 FIRs against gangster Kapil Sangwan's gang—Balyan has no ties.
The court issued notice to police on June 25, 2025. Earlier bail withdrawn post-chargesheet, lower court rejected May 27, 2025. Balyan was re-arrested under MCOCA December 4, 2024 after extortion bail, linked to 2023 audio clip with UK-based gangster Sangwan (Najafgarh native, mastermind in Nafay Singh, Ballu Pahalwan, Surendra Matiala murders). Balyan represented Uttam Nagar in 2015 and 2019.
