New Delhi, May 7 (HS): Former Delhi MLA Naresh Balyan has withdrawn his bail application filed in the MCOCA case from the Delhi High Court. The Advocate representing Naresh Balyan stated in the High Court that a charge sheet has been filed in this matter, and hence, they are withdrawing the bail application. Following that, the High Court granted permission to withdraw the bail application.
In this matter, the Rouse Avenue Court had taken cognizance of the supplementary charge sheet filed by the Delhi Police against Naresh Balyan and four other accused on May 5. During the hearing in the High Court, the Delhi Police opposed Balyan's bail application, stating that a case under MCOCA is applicable against Balyan. During the hearing, Special Public Prosecutor Amit Prasad, representing the Delhi Police, read the provisions of MCOCA and stated that if anyone helps in any way with the crime, they will fall under the purview of MCOCA. Amit Prasad mentioned that the charge sheet mentions a gang, and it is not just about the role of a single person. An eyewitness mentioned in the FIR filed in 2019 was murdered in 2024, indicating collusion by the accused.
During the hearing on the bail application, Naresh Balyan's lawyer, M.S. Khan, stated that the charges under MCOCA do not apply to Balyan, as continuous criminal activity is necessary for that. However, no new crime or activity has been recorded in the FIR.
