New Delhi, 14 May (H.S.): The Supreme Court, while hearing the dispute over late industrialist Sunjay Kapur's property worth 30 thousand crore rupees, ordered a stay on the agenda for the appointment of independent directors and changes in authorized persons for bank operations at the board meeting scheduled for May 18. A bench presided over by Justice JB Pardiwala issued these orders on the application of Sunjay Kapur's mother, Rani Kapoor.
The court stated that until the mediation process is ongoing in this case, all parties should not escalate the dispute.
Rani Kapur had filed an application in the Supreme Court seeking to restrain Priya Kapur and others from interfering in the functioning of the RK Family Trust until the mediation process in this matter is completed. In her new application, Rani Kapur had also sought a stay on the RK Family Trust's board meeting scheduled for May 18. This meeting was called on the notice of Raghuvanshi Investment Private Limited, which is said to hold control over a major portion of the disputed property. Rani Kapur's application stated that the main purpose of this meeting is to appoint new directors of their choice on the board.
The Supreme Court on May 7 appointed former Chief Justice DY Chandrachud as mediator to resolve the ongoing dispute between Rani Kapur and Priya Kapur regarding the Sona Group family trust.
Sunjay Kapur's mother Rani Kapur has demanded the dissolution of the family trust RK Family Trust. In her petition, Rani Kapur stated that the formation and management of the RK Family Trust are under scrutiny.
The petition states that the RK Family Trust was formed without the petitioner's knowledge or consent. For this reason, the petitioner was excluded from the trust. All the property of the trust belonged to her, but she was not even informed when the trust was formed. At the time of the trust's formation, she had suffered a heart stroke, due to which her health was poor. Rani Kapur stated that signatures were taken on the trust documents without her knowing their content. Signatures were obtained on some blank papers.
