Guwahati, 08 April (HS): Authorities have issued a directive to all electronic media houses to strictly comply with the provisions of the Representation of the People Act, 1951, particularly Section 126, which mandates a ban on election-related content during the 48-hour silence period prior to the conclusion of polling.
According to an official communication addressed to Editors-in-Chief of electronic media organizations, the advisory reiterates that no person or platform shall convene, attend, or address any public meeting or procession connected with elections during this restricted period. It also prohibits the display or dissemination of election-related content through television, cinematography, or similar broadcasting platforms.
The notification further clarifies that any form of propagation of election matter, including through entertainment programs such as musical concerts, theatrical performances, or other public engagements intended to influence voters, is strictly barred within the silence period in polling areas.
As per the legal provisions, any violation of Section 126 may attract penal action, including imprisonment for up to two years, a fine, or both. The term “election matter” encompasses any content intended or calculated to influence or affect the outcome of an election.
Officials have emphasized that electronic media platforms must ensure that no news, analysis, panel discussions, advertisements, or related broadcasts that could influence voters are aired during the silence period. The directive calls for strict adherence to ensure the conduct of free and fair elections.
The advisory has been issued as a reiteration of earlier instructions, with authorities warning that necessary action will be taken upon receipt of any complaint regarding violations.----------
