Hearing in Rahul Gandhi's case in High Court postponed till September 3

01 Sept (HS): The hearing in the court of Justice Sameer Jain in Allahabad High

Court on the criminal revision filed in the case of the controversial statement

given by Rahul Gandhi regarding Sikhs in America has been postponed till

September 3. Senior advocate Gopal Swaroop Chaturvedi appeared on behalf of

Rahul Gandhi and Satyendra Kumar Tripathi and Aman Singh Visen appeared on

behalf of the opposite party. Additional Advocate General Manish Goyal appeared

on behalf of the state. The court has fixed the next hearing on September 3.

It

is known that Congress MP and Leader of Opposition in Lok Sabha Rahul Gandhi

has challenged the order of Varanasi MP MLA court in Allahabad High Court. On

July 21, the court had accepted the monitoring petition demanding registration

of FIR against him for his statement on Sikh community in America. Rahul Gandhi

has filed a review petition in the High Court against this order.

In

September 2024, during a program in the US, Rahul Gandhi had allegedly said

that the environment in India is not good for Sikhs; Sikhs wear turbans, keep

Kada and go to Gurudwaras? His statement was termed inflammatory and divisive

in the society and there was protest.

Mishra, a resident of Varanasi, had given a written complaint to Sarnath police

station to register an FIR against this statement, but the FIR was not

registered. On this, he filed a complaint in the court. The Judicial Magistrate

(II) dismissed the case on 28 November 2024, saying that the matter is related

to the speech given in America and it is outside his jurisdiction. After this,

Nageshwar Mishra filed a monitoring petition in the Sessions Court, which was

accepted by the court of Special Judge (MP MLA) on 21 July 2025. Now Rahul

Gandhi has filed a review petition in the High Court against this decision. It

has been argued that the order of the Varanasi court is wrong, illegal and

beyond jurisdiction. Therefore, as long as this matter is pending in the High

Court, the order of the Varanasi court should be stayed.
