01 Sept (HS): Chief Minister Yogi Adityanath has stressed the need to implement

a new law in Uttar Pradesh in place of the Society Registration Act, 1860. He

has said that contemporary and practical provisions should be made to

strengthen the registration, renewal and transparent management of the

properties of institutions registered as societies.

Chief

Minister Yogi said that the current Act lacks clear provisions for ensuring

transparency and accountability, cancellation/dissolution of inactive or

suspicious institutions and safe management of property, and timely resolution

of disputes related to membership, management and elections. Similarly, rules

related to audit, control over misuse of funds and property management are also

not sufficient for financial discipline. In such a situation, it is necessary

that a contemporary Society Registration Act be implemented keeping in mind

practicality.

While

discussing the proposed act in a meeting held at Chief Minister's residence 5

Kalidas Marg on Monday in the presence of Finance Minister Suresh Khanna, the

Chief Minister said that such provisions should be made in it which ensure

transparency, accountability and protection of member interests. He said that

concrete arrangements should be made to prevent arbitrary sale of properties of

institutions, be it a trust or a society, due to the malicious mentality of

some people. Terming the appointment of an administrator in case of dispute as

inappropriate, the Chief Minister said that the management committee should

decide how the institution will be run even in adverse circumstances. There

should be minimum interference from the government or the local administration

in the internal functioning of the institutions.

The

Chief Minister said that at present more than eight lakh institutions are

registered in the state, whose activities are related to many fields like

education, health, social harmony, rural development, industry, sports etc.

Therefore, it is necessary to streamline the arrangements related to their

operation, membership, election and financial discipline. He said that there

should be concrete provisions in the Act for dissolution, cancellation and safe

management of property of inactive or suspicious institutions. Along with this,

it would be appropriate to make arrangements for quick and timely resolution of

membership disputes, differences in the management committee, financial

irregularities and election related disputes.

The

Chief Minister also said that the process of registration and renewal should be

online, KYC based and time bound. There is a need to further strengthen the

process of accountability and audit of financial transactions. While giving

instructions to prepare the new law as soon as possible, the Chief Minister

said that all the necessary provisions should be prepared in such a way so that

the registered institutions of the state can perform social welfare works more

effectively and can promote the spirit of transparency and good governance.
