New Delhi, 07 February (HS): The Supreme Court refused to hear the contempt petition filed on bulldozer action without notice in Sambhal, Uttar Pradesh. The bench headed by Justice BR Gavai advised the petitioner to go to Allahabad High Court.

Sambhal resident Mohammad Ghayur had said in the petition filed that one of his properties in Sambhal was demolished between January 10 and 11. The petition said that the demolition of his property at Tiwari Sarai located on Behjol Road in Sambhal between January 10 and 11 without giving any notice is a violation of the guidelines of the Supreme Court.

Earlier on November 13, 2024, the Supreme Court had issued guidelines on this matter and said that if the house of an accused or convict is demolished without following the process of law, his family will be entitled to compensation. Also, action will be taken against officials who work arbitrarily or illegally. The Supreme Court had said that the executive cannot become a judge and take a decision to demolish the property of an accused. The job of dispensing justice is that of the judiciary. The executive cannot replace the judiciary. The court had said that one's home is one's hopes. Everyone dreams that his shelter should never be taken away and everyone dreams that he should have shelter.
