Nagpur, 07 Jan
(HS): Underworld don Arun Gawli has been granted Furlough leave by the Nagpur
Bench of the Bombay High Court. Gawli had approached the court praying for his
release on Furlough after the application was rejected by the DIG (Prisons).
Justice Sambre
and Justice Joshi allowed the petition and granted him leave. The respondent
opposed the petition on the grounds that Gawli is a gangster and his release may
cause a law and order situation. Gawli’s application was rejected also quoting
the ground that his daughter may contest the Assembly elections. The respondent
said that the Parole and Furlough rules have been amended recently, which bars the grant of Furlough to a convict under the Maharashtra Control of Organised Crimes
Act (MCOCA).
Earlier Gawli
was released on Parole and Furlough. The jail authorities had not quoted any
threat to the law and order situation then. It was further submitted that the
Assembly elections are over. The said amendment to the rules were enforced after the rejection of Gawli’s application. The amended rules would not apply to his
petition.
