New Delhi, 3 January (H.S.): The Supreme Court has said that the right to property is a constitutional right. A bench headed by Justice BR Gavai said that no one can be deprived of his property without proper compensation according to the law.

The court said that even though the right to property is not a fundamental right, it is a constitutional right according to Article 300-A of the Constitution. The court said that a person cannot be evicted from his land without proper compensation.

The court gave this decision while hearing the petition of people who gave their land for the Bengaluru Mysore Infrastructure Corridor project two decades ago. The court said that in this case the landowners were not only deprived of compensation, but they had to go to the courts for about 22 years for their legitimate rights. Therefore, the amount of compensation cannot be fixed from the time when the acquisition process started.
