New Delhi, 19 August (H.S.): The controversy surrounding the film ‘Kala Hiran: The Battle For Legacy.’ Case Reaches Supreme Court as Producer Challenges High Court Stay’ has reached the Supreme Court, with producer Amit Jani challenging the Delhi High Court’s order restraining the film’s release.

The film’s producer has challenged before the Supreme Court the Delhi High Court’s July 27 order directing the removal of the film’s teaser and related promotional content. The petition contends that the High Court’s order imposes an unreasonable restriction on the filmmaker’s freedom of expression.

The petition argues that making a film and presenting a public incident from the filmmaker’s own narrative perspective falls within the ambit of the fundamental right to freedom of expression. The producer had advanced a similar argument before the Delhi High Court, stating that Salman Khan’s name was not directly mentioned anywhere in the teaser.

Salman Khan had approached the Delhi High Court seeking protection of his personality rights. During the proceedings before the High Court, advocate Ravi Prakash, appearing for Salman Khan, sought a stay on the film and its trailer, alleging that the filmmakers were commercially exploiting the actor’s personality without his consent.

In his petition, Salman Khan had stated that the film relates to the 1998 blackbuck poaching case associated with him and contended that the film’s release would infringe upon his personality rights.
