
New Delhi, 12 May (H.S.): Rani Kapoor, the mother of the late industrialist Sanjay Kapoor, has moved the Supreme Court, seeking to prevent Priya Kapoor and others from interfering in the functioning of the RK Family Trust until mediation proceedings take place. During the hearing on Tuesday, a bench headed by Justice J.B. Pardiwala quipped that, on closer examination, the Mahabharata might seem “very small” in comparison to this case, and added that the matter would be looked into. The Court has listed the case for further hearing on 14 May.
In her fresh petition, Rani Kapoor has also requested the Court to stall the board meeting of the RK Family Trust scheduled for 18 May. The meeting was convened pursuant to a notice issued by Raghuvanshi Investments Private Limited, which is alleged to control a substantial portion of the disputed property. The petition alleges that the main purpose of the meeting is to appoint new directors of the board favoured by the petitioner’s opponents.
On 7 May, the Supreme Court had appointed former Chief Justice of India D.Y. Chandrachud as mediator to resolve the ongoing dispute between Rani Kapoor and Priya Kapoor over the Soni Group family trust. Rani Kapoor has further sought the dissolution of the RK Family Trust, arguing that the circumstances surrounding its creation and subsequent management raise serious questions.
The petition contends that the RK Family Trust was formed without the knowledge or consent of the petitioner, effectively excluding her from the trust despite the fact that all the trust property originally belonged to her. It adds that she was not even informed at the time of the trust’s formation, and that she had suffered a cardiac stroke then, which kept her in poor health.
