New Delhi, 17 April (H.S.): The Dwarka Court has reserved its order on a plea seeking cancellation of bail granted to a minor accused in a fatal road accident that occurred in February, deciding to pronounce its verdict on April 20. Additional Sessions Judge Rajat Goyal adjourned the matter after a detailed hearing, keeping the decision “reserved” and indicating that the judgment will be delivered on the specified date.
The petition was filed by Inna Markan, mother of Sahil Dhanehra, who died in the crash, and challenges the order of the Juvenile Justice Board that released the underage accused on bail.
The petitioner has alleged that the Board passed the order without properly examining the evidence, while the case investigation is still in its preliminary stage and the minor is described as a repeat offender.
According to the plea, the vehicle involved in the accident has been linked to multiple prior incidents, including cases of over‑speeding and driving without a valid licence, and has accumulated several traffic challans.
The petition claims that when the juvenile was produced before the Board on February 4, he showed no remorse over the death, and no notice was served to the victim’s family before bail was granted on February 10.
The petitioner further contends that in such circumstances there is a serious apprehension that the accused’s father and associates may attempt to influence the ongoing investigation.
The tragedy unfolded on February 3 when Sahil, riding a motorcycle, was hit at high speed by an SUV driven by the juvenile, resulting in fatal injuries and extensive damage to the bike. A cab driver who was nearby also sustained grievous injuries in the incident.
The court’s upcoming judgment will determine whether the Juvenile Justice Board’s bail order stands or is set aside in view of the severity of the offence and the concerns raised by the victim’s family.
