Kochi, 04 Nov (H.S.):
The Kerala High Court has directed motor vehicle authorities to initiate stringent action, including cancellation of driving licences, against motorists who cause accidents while driving under the influence of alcohol, without waiting for the completion of criminal proceedings.
The court observed that licensing authorities rarely exercise their powers to cancel driving licences, despite the serious threat posed by drunken driving to public safety.
The observations came while considering the bail application of an accused involved in a fatal road accident at Kunnamkulam in Thrissur district. The accident, allegedly caused by drunken driving, resulted in the death of a motorcyclist.
While granting bail to the accused, the High Court directed investigating officers to immediately forward his driving licence and relevant documents to the licensing authority for appropriate action.
The court also instructed the State Transport Commissioner to ensure that necessary proceedings are initiated for cancellation of the licence.
Emphasising the need for prompt administrative intervention, the court said licensing authorities should act immediately whenever prima facie evidence establishes that a motorist was driving under the influence of alcohol and caused an accident.
The court made it clear that such administrative action need not be delayed until the criminal trial concludes.
Referring to road safety guidelines issued by the Supreme Court-appointed Committee on Road Safety, the High Court noted that driving licences should be suspended for three months in cases involving serious traffic violations, including drunken driving.
The court also recalled the Supreme Court's position that road safety forms an integral part of the fundamental right to life guaranteed under Article 21 of the Constitution.
The observations underline the responsibility of transport authorities to take preventive and punitive measures against dangerous driving practices, particularly those involving alcohol, to protect other road users and prevent avoidable fatalities.
