New Delhi, 29 October (H.S.): The Delhi High Court on Thursday directed former Indian cricket captain Sourav Ganguly to identify specific portions of the film ‘Doosra’ that allegedly infringe his personality rights. Justice Tejas Karia also directed the defendants to submit a pen drive containing the film and scheduled the next hearing in the case for November 2.
Ganguly has filed a lawsuit against the filmmakers, alleging the unauthorised commercial use of his name, image and references to his life without his consent.
In his petition, Ganguly has sought a stay on the film’s release, citing references to significant events from his cricketing career, particularly his captaincy during the final of the NatWest cricket series in 2002 and his iconic shirtless celebration on the balcony at Lord’s following India’s victory.
The petition alleges the unauthorised commercial exploitation of Ganguly’s personality rights and a violation of the exclusive contractual rights held by production house Luv Films over a proposed biographical film based on his life.
Ganguly and Luv Films have sought an injunction restraining the film’s theatrical, digital and other releases, as well as the circulation of promotional material allegedly using his name, image, likeness and iconic cricketing moments without authorisation.
The court has asked Ganguly’s side to specify the particular scenes it considers objectionable, enabling the bench to examine the disputed portions before deciding whether interim relief is warranted.
The case centres on competing claims concerning the use of Ganguly’s identity and cricketing legacy in ‘Doosra’, as well as the contractual rights claimed by Luv Films in relation to its proposed biopic.
