New Delhi, 17 October (H.S.): Abhijeet Dipke, founder of the Cockroach Janata Party (CJP), has been granted conditional bail by the Special Executive Magistrate at Mandir Marg in Delhi. The magistrate ordered his release on a peace bond of Rs 50,000, requiring him to maintain peace for one year.

Dipke was arrested by Delhi Police on October 16 while he was on his way to Connaught Place to participate in the ‘Lehra Do Tiranga’ protest organised at Central Park. He was taken into custody from his residence in Jhandewalan. At around noon on October 16, more than 20 Delhi Police personnel arrived at his residence and served him with a notice directing him to refrain from any activity that could adversely affect the rights of citizens, traders, commuters, patients or other members of the public.

Earlier, Dipke had also been detained along with fellow Cockroach Janata Party leaders Saurav Das and Ashutosh Ranka while they were still aboard an aircraft after arriving in Delhi to protest against Chief Election Commissioner Gyanesh Kumar. They were subsequently released on peace bonds requiring them to maintain peace in the concerned area for one year.

According to Delhi Police, action was taken against Dipke under Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). Neha Bora, who was detained along with him, was also released on Saturday after the completion of the formalities.

Section 126 of the BNSS empowers an Executive Magistrate to initiate preventive proceedings against a person when there is reason to believe that the person may breach the peace or disturb public order. Section 170 authorises a police officer to make a preventive arrest without a warrant or a magistrate’s order when necessary to prevent the commission of a cognisable offence.
