03 Sept (HS): On Wednesday, the Allahabad High Court postponed its
decision on a special court's ruling asking the magisterial court to hear a
petition for a FIR against Congress MP Rahul Gandhi over a comment he made in
the United States. Acting on Gandhi's criminal revision, Justice Sameer Jain
stated that the special court's ruling will remain reserved. One Nageshwar
Mishra of Varanasi petitioned the magisterial court to order the police to file
a FIR against Gandhi, claiming that during an event in September 2024, Gandhi
reportedly stated that the environment in India was not healthy for Sikhs. Mishra
said his comment was controversial and polarizing. On November 28, last year,
the magisterial court dismissed the request, stating that the statement was
delivered in the United States and so the subject was beyond its authority.
Mishra
then appealed the ruling before a revisional court, which upheld it on July 21
and ordered the magisterial court to hear the case again. He attempted to file
a FIR against Gandhi at the Sarnath police station in Varanasi, but was
unsuccessful. Gandhi petitioned the high court, and his attorney contended that
the Varanasi court's ruling was incorrect, illegitimate, and lacked
jurisdiction.
