Prayagraj, 04 July (HS): Allahabad High Court has rejected the
petition seeking to declare Shahi Idgah in Mathura as a disputed structure.
This order was given by Justice Ram Manohar Narayan Mishra on Friday.
The
court had reserved its decision on 23 May after the completion of the debate on
declaring Shahi Idgah in Mathura as a disputed structure. In the petition,
citing the history books written during the time of Masre Alam to FS Growse,
who was the collector of Mathura, it was said before the court that there was a
temple there earlier; the Intezamia Committee has not been able to present any
evidence of the mosque till now. Neither is the name of the mosque mentioned
anywhere in the Khasra Khatauni. Neither is there any record of it in the
Municipal Corporation nor is any tax being paid. Even the report of electricity
theft has been filed against the Intezamia Committee. Therefore, the mosque
should be declared a disputed structure. It was also said that all this will
become clear in the survey of the Archaeological Survey of India. The court on Friday
gave its decision to reject this petition.
On
Friday, the parties presented their arguments for representation under Order 1
Rule 8 of the CPC in the original case. The court has fixed July 18 as the next
date of hearing in the case and has asked to pass an order on the issue of
Order 1 Rule 8 of the CPC on that day.
