28 June (HS): On Saturday, Chief Justice of India BR Gavai stated that Dr. BR
Ambedkar envisioned a single Constitution for the country to keep it unified
and never supported the concept of a separate constitution for each state. Speaking at the opening of the Constitution
Preamble Park here, the Chief Justice said the Supreme Court was inspired by
Dr. Ambedkar's vision of a unified India under a single constitution in
supporting the Centre's decision to repeal Article 370, which conferred special
status to Jammu and Kashmir.
Gavai
was a member of a five-judge Constitution panel led by then Chief Justice DY
Chandrachud that unanimously backed the Centre's decision to repeal Article
370, which granted special status to the erstwhile state of Jammu and Kashmir.
When
Article 370 was challenged, it came before us, and as the hearing began, I
remembered Dr Babasaheb's statements that one Constitution is suitable for a
country... When addressing the audience
in Marathi, he stated that if we want to keep the country unified, we simply
need one Constitution. On August 5, 2019, the Centre resolved to deprive Jammu
and Kashmir of its unique status and partition it into two union territories.
Gavai
stated that Dr. Ambedkar had been chastised, claiming that the Constitution
allows for too much federalism and that the country may not remain together
during a conflict. However, he reacted by stating that the Constitution will
meet all of the obstacles and keep the country unified, according to the CJI.
Consider
the condition in bordering nations, such as Pakistan, Bangladesh, and Sri
Lanka. Gavai stated that whenever our
country encounters a difficulty, it remains unified. On the occasion, Union
Minister Nitin Gadkari expressed his satisfaction that CJI Gavai inaugurated
the Constitution Preamble Park and unveiled a monument of Dr Ambedkar. Dr.
Ambedkar's Constitution provided the country with freedom, equality, and
fraternity, he stated. Gadkari claimed that the Constitution clearly defines
the roles and rights of the four pillars of democracy: the executive,
judiciary, legislature, and media.
According
to Chief Minister Devendra Fadnavis, Gavai is doing an excellent job as India's
Chief Justice. Fadnavis emphasized the importance of the Constitution, stating
that the government has determined that the Preamble of the Constitution shall
be distributed to all students as part of the Constitution's Amrit Mohotsav
campaign. If we adopt the Preamble's values, 90% of the country's issues would
be permanently fixed, he stated.
