Calcutta HC dismisses PIL challenging construction of Babri Masjid


Kolkata, 18 December (H.S.): The Calcutta High Court has dismissed a public interest litigation (PIL) filed in the court challenging the decision to construct a Babri Masjid in Beldanga, Murshidabad, West Bengal, by Humayun Kabir, a legislator expelled from the Trinamool Congress. A division bench of Acting Chief Justice Sujoy Pal and Justice Parthasarathi Sen dismissed the case on Thursday. The bench of the two judges stated that the case was not maintainable.

Humayun Kabir, a suspended Trinamool Congress MLA from Bharatpur, had started the construction of the Babri Masjid in Beldanga without the permission of the district administration. A PIL was recently filed in the High Court with this allegation. The High Court dismissed the case on Thursday.

The bench of the two judges argued that such a case filed by an individual is not maintainable. The Acting Chief Justice commented that the land where the mosque is being constructed is not government land. It is the land of a trust. Therefore, the objection to the construction work there is baseless. Furthermore, according to the court, the case is flawed. Therefore, no application in this regard will be considered.

Notably, on December 6, the anniversary of the demolition of the Babri Masjid in Ayodhya, Humayun Kabir laid the foundation stone of a mosque with the same name in Murshidabad. Since Humayun announced the date of the mosque's foundation stone laying ceremony, the Trinamool Congress had distanced itself from the MLA.

A PIL was filed in the Calcutta High Court regarding the mosque's foundation stone laying ceremony. The petitioner claimed that Humayun's proposal to construct the mosque was unconstitutional. Even at that time, the High Court did not intervene in the matter. The bench of the two judges had said that Humayun would have to organize the program while maintaining law and order. The state was also directed to maintain law and order.

This case has been mired in controversy from the beginning. The decision to build a mosque with the same name on the anniversary of the Babri Masjid demolition was highly controversial. The Trinamool Congress had also distanced itself from Humayun Kabir in this matter. However, the High Court has now clarified that the construction is on private land and there is no legal basis for objecting to it.
