Delhi, 3 November (H.S.): The Punjab and Haryana High Court has dismissed a petition filed by a retired BSF constable, Suraj Bhan, who sought appointment as a Haryana Police constable under the ex-servicemen category. The court noted that the Haryana government has not adopted the Centre’s policy extending ex-servicemen benefits to retired personnel of the Central Armed Police Forces (CAPF).

Bhan, who retired from the Border Security Force (BSF) in July 2014, had applied for the police constable post in 2015 under the ex-servicemen quota. He approached the court after not receiving an appointment letter despite fulfilling the eligibility criteria under the central government policy.

The court observed that while the Union government’s policy recognizes retired CAPF personnel as ex-servicemen, state governments are not bound to follow it unless they formally adopt the same.

Dismissing the plea, the bench clarified that in the absence of a corresponding state notification, retired CAPF personnel cannot claim ex-servicemen benefits for recruitment to Haryana Police or other state government services.
