New Delhi, 09 June (H.S.): The Rouse Avenue Court on Tuesday issued another non-bailable warrant against proclaimed absconder Kapil Sangwan alias Nandu, an accused in a case under the Maharashtra Control of Organised Crime Act (MCOCA) and linked to a matter involving Aam Aadmi Party leader Naresh Balyan. Special Judge Vishal Gogne directed Sangwan to appear before the court on July 9.

During the hearing on June 3, the court had sought an update from Delhi Police regarding the whereabouts of absconding accused Kapil Sangwan. The investigating officer informed the court that no trace of him had been found so far.

The court noted that Delhi Police, in its charge sheet, had sought permission to commence trial against Kapil Sangwan in his absence under Section 356 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The court observed that under Section 356(1), before initiating a trial in absentia, it is mandatory to issue two consecutive warrants, with a minimum gap of 30 days between them.

Consequently, the court had issued a warrant against Sangwan and directed him to appear on Tuesday. As he failed to do so, the court issued a second non-bailable warrant and scheduled the matter for further proceedings on July 9.

In the case, Delhi Police filed its sixth supplementary charge sheet on April 17. Earlier, on January 24, the court had taken cognisance of the fifth supplementary charge sheet filed against Manoj Yadav alias Kaira. The court took cognisance of the charges under Sections 3 and 4 of MCOCA against him.

According to the charge sheet, Manoj Yadav is a member of an organised crime syndicate allegedly operated by Kapil Sangwan alias Nandu, who remains absconding. Delhi Police's investigation revealed that several FIRs relating to criminal activities had been registered against Manoj Yadav.

According to Delhi Police, the case involving conversations between Naresh Balyan and a gangster dates back to 2023, and an FIR was registered the same year. Kapil Sangwan is a notorious gangster who has reportedly been residing in the United Kingdom for the past five years. Both Kapil Sangwan and Naresh Balyan are residents of the Najafgarh area of Delhi.

Investigators have also identified Sangwan as the alleged mastermind behind the murder of Haryana political leader Nafe Singh Rathee. He is further suspected of orchestrating the killings of wrestler Ballu Pehlwan and BJP leader Surender Matiala.

Naresh Balyan represented the Uttam Nagar Assembly constituency in Delhi after winning elections in 2015 and 2019.
