SC adjourns petition challenging reservation to poor of general category
New Delhi, March 11 (HS): The Supreme Court has adjourned the hearing on petition filed against 103rd Amendment of the Constitution entitling 10 percent reservation to economically weaker sections for March 28. The petition alleges that it violates the basic spirit of Constitution, economic criterion cannot be the sole basis for reservation, violates the maximum reservation limit of 50 per cent mandated by the constitution bench of the Supreme Court in Indira Sahni case etc. Though the Court refused to ban it but the Chief Justice said if needed then the matter may be referred to big bench. It is notable that on Jan. 7 the Union Cabinet had approved 10% reservation of economically weaker section of general category of poor people in government jobs and in education. Later it was made law of land by 103rd Constitution Amendment Act and thereafter several states including Uttar Pradesh, Himachal Pradesh, Gujarat, Assam, Jharkhand, Bihar and Maharashtra, have implemented this new system of 10 percent reservation.
